Terms of Use for Bogeme.com (User Agreement)

Last Updated: October 7, 2026

PLEASE READ THIS AGREEMENT CAREFULLY. BY ACCESSING, BROWSING, REGISTERING, OR USING THE BOGEME.COM PLATFORM, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND UNCONDITIONALLY ACCEPT ALL THE TERMS AND CONDITIONS OF THIS AGREEMENT. IF YOU DO NOT AGREE TO THESE TERMS, YOU ARE STRICTLY PROHIBITED FROM USING THE PLATFORM AND MUST IMMEDIATELY CEASE ALL INTERACTION WITH THE INTERFACE AND SMART CONTRACTS.

1. General Provisions and Legal Nature of the Service

1.1. Software Infrastructure Architecture

BOGEME (hereinafter referred to as the "Platform", "we", "us", or "our") is a provider of non-custodial software infrastructure and smart contract infrastructure operating on the Base blockchain network. The Platform is not a bank, a credit institution, or an escrow agent, and it does not take users' funds onto its own accounts for onward settlement in its own name.

1.2. No Financial Intermediation

The Platform provides non-custodial graphical user interfaces that interact with our smart contracts and autonomous smart contracts that allow registered users ("Creators") to provide access to their digital content, chat channels, or media assets to other users ("Subscribers") in exchange for cryptographic assets (specifically stablecoins such as USDC). Payments are executed on-chain: the user authorizes each operation, including through a limited session key granted with the user's consent. The Platform does not store seed phrases or owner keys and does not dispose of a user's funds beyond a predefined on-chain policy that the user can revoke.

1.3. Autonomous Peer-to-Peer Transactions

All transactions, including subscriptions, one-time payments, and direct tips ("Donations"), are executed directly between the Creator and the Subscriber on a peer-to-peer (P2P) basis within the immutable Base blockchain network. The Platform is not a party to, broker of, or guarantor for any agreements, interactions, or contractual relationships established between Users and Creators.

1.4. Non-Custodial Model with Session Key Exception

At no point does the Platform collect, hold, manage, or take custody of fiat currency or users' primary digital assets. We do not store, possess, or have access to your cryptographic data, root private keys, seed phrases, or backup files. The sole exception is the Session Key utilized for automated subscription renewals – a strictly limited cryptographic key stored on the Platform's server in an encrypted format (Fernet/AES) exclusively for auto-renewal purposes under the specified on-chain policy. This Session Key does not grant access to the main balance of the user's Smart Account and can only initiate a strictly constrained set of operations (see Section 3.3). The primary owner key (owner key / embedded wallet powered by Dynamic.xyz) is never stored by the Platform and cannot be recovered by us. You retain absolute control over and are solely responsible for the safety and security of your cryptographic assets and connected accounts.

1.5. Network Environment and Testnet Status

The Platform currently operates in a pre-commercial testing environment on the Base Sepolia test network (chain ID 84532). During this phase, the tokens, balances, subscriptions, and transactions referenced throughout this Agreement – including all references to USDC – are simulated test-network assets that may carry no monetary value, are not redeemable for fiat currency or other real-world assets, and cannot be withdrawn, exchanged, or liquidated. All contract addresses, fee parameters, and network configurations described in this Agreement are subject to change, and the Platform may migrate to the Base mainnet (and to transferable, economically valuable stablecoins) upon commercial production launch. Upon such migration, this Section will be updated to specify the live network and applicable assets; prior test-network interactions shall not constitute or evidence any entitlement to real-world value.

2. Registration, Web3 Authentication, and Security

2.1. Age Requirements

You must be at least 18 years of age (or the minimum legal age of majority in your specific country of residence) to register an account or access the functional elements of the Platform. If you do not meet this requirement, your registration and use of the Platform are strictly prohibited.

By creating an account or connecting a wallet, you represent and warrant that you are at least 18 years of age and that you accept these Terms of Use and the Privacy Policy.

2.2. Web3 Hybrid Authentication

Registration and account access are powered by an advanced non-custodial Web3 integration architecture via Dynamic.xyz. Users may authenticate their session using an email address, a social media profile link, or by connecting an external independent cryptographic hardware or software wallet (e.g., MetaMask, Trust Wallet, Coinbase Wallet, and other compatible wallets).

2.3. Smart Account Provisioning

Upon initial authentication via email or social credentials, the system programmatically provisions an embedded non-custodial cryptographic Smart Account (ERC-4337 architecture) on the Base blockchain network. This address is unique to your authentication method and serves as your destination repository for transaction signatures.

2.4. Account Security

You are solely and exclusively responsible for restricting access to your devices and maintaining the strict confidentiality of your authentication logs, sessions, and linked email accounts. You accept full liability for all activities, code executions, and smart contract signatures initiated under your linked account profile.

2.5. Prohibited Jurisdictions and Anti-Money Laundering (AML) Compliance

The Services are not directed to, and registration is strictly prohibited for, residents or citizens of countries subject to comprehensive international trade sanctions or economic embargoes (including lists maintained by OFAC, the European Union, and the United Nations).

2.6. Blockchain Analytics Screening

By connecting to the Platform, you warrant that your cryptographic wallet address and provisioning email are not blacklisted, flagged, or designated as "High Risk" by international regulatory compliance networks, law enforcement systems, or automated blockchain analytics protocols (e.g., Chainalysis, Elliptic, HAPI). If automated systems flag your connected cryptographic address as high-risk or illicit, the Platform reserves the absolute right to block or terminate your interface access instantly and without prior notice.

3. Platform Fee, Transaction Logic, and Gas Reimbursement

3.1. Platform Fee

In consideration for providing the software infrastructure and user interface services, the Platform fee is fixed within the Platform's smart contract, currently set at eight percent (8%) on all incoming payments processed through the Platform's core smart contracts. This fee is automatically calculated, separated, and deducted at the blockchain code level in real-time during transaction execution: the Platform's portion (8%) is routed to the Platform treasury address, while the Creator's net income (92% of the payment) is credited directly to the Creator's Smart Account. The Platform administration reserves the right to modify the Platform fee by updating the value in the smart contract via the setPlatformFee function; however, a strict hard cap is hardcoded into the contract level at no more than eight percent (8%), which cannot be exceeded under any modification circumstances. All fee adjustments apply immediately to all subsequent transactions.

3.2. Gas Reimbursement Fee Model

All transactions executed on the Base blockchain network require network gas fees (in ETH). The Platform supports two methods of payment for transaction processing:

  • (a) Payment via Smart Account: The Platform utilizes an Account Abstraction model (ERC-4337 standard) with an ERC-20 Paymaster infrastructure. The user DOES NOT require native cryptocurrency (ETH) to pay for gas – instead, the equivalent cost of gas is automatically withheld from the user-transactor's active USDC smart account balance at the moment of transaction execution. The Paymaster pre-sponsors the transaction gas and then deducts the corresponding USDC amount from the user's account. This refers to the USDC held in your own smart account; the Platform does not maintain any separate custodial balance on your behalf.
  • (b) Payment via External Wallet (EOA): When connecting an external cryptographic wallet (e.g., MetaMask, Trust Wallet), the user pays network gas fees directly in ETH from their wallet. Transactions are signed by the user personally and sent to the Base blockchain network without the involvement of intermediaries. The Platform can attribute a payment to you only when it originates from a wallet linked to your account (your embedded Smart Account or your connected external wallet); transfers from addresses that are not linked to your account cannot be credited to your account or grant access to paid content.

3.3. Automatic Renewals and Session Keys (Security)

Upon subscription setup, the automatic renewal feature is activated by the user and secured via a decentralized mechanism of Session Keys (Scoped Signers). This mechanism acts as a strictly limited digital power of attorney deployed on the user's smart account via a third-party account abstraction infrastructure. The key is bound by rigid parameters established by the on-chain policy at the moment of its deployment:

  • (a) It can exclusively invoke exactly one function on the Platform's smart contract – autoRenewFromSmartAccount – designed solely for the automated renewal of the specific subscription tier for which the key was provisioned. Within that same auto-renewal operation, the key is permitted a bounded spending allowance (approve) targeted at the Platform's smart contract or the ERC-20 Paymaster infrastructure, strictly capped at the volume required to fulfill the renewing subscription cost and the network gas for that transaction. The initial subscription purchase (directSubscription) and subscription level upgrades (directUpgradeSubscriptionWithDiscount) are executed as standalone transactions signed directly by the user's primary owner key (owner key of the smart account) and cannot be initiated by the Session Key;
  • (b) It technically possesses no structural capacity to deduct funds exceeding the baseline cost of the selected subscription tier;
  • (c) It features a strictly limited expiration period.
  • (d) Automatic Renewal Cancellation Procedure: The user can deactivate the automatic renewal feature at any moment through the Platform's interface via the "My Subscriptions" page by unchecking the auto-renewal box or clicking the "Cancel" button for the respective subscription. Following cancellation, the Platform immediately and irreversibly ceases to initiate any deductions from the user's smart account for that subscription. The user's access to the Creator's content remains active until the expiration of the current paid period (expires_at). Managing session key permissions directly on the blockchain level (including its complete on-chain removal via uninstalling the plugin) is managed by the user independently and is not programmatically performed by the Platform automatically. Upon re-enabling auto-renewal, the previously generated session key is re-used without requiring a new signature, provided its expiration period has not lapsed.

The user acknowledges that the session key is a non-custodial tool: the session key does not grant the Platform access to funds outside the boundaries of the on-chain policy; the Platform utilizes it solely to trigger auto-renewals while the feature remains enabled by the user. The user retains the absolute right to manually revoke the session key or disable auto-renewal in the interface at any second, stopping any subsequent automated deductions by the Platform. The on-chain permission may remain active until the key's expiration or until its manual revocation by the user using external wallet or network tools, if applicable. The Platform acts solely as a user interface provider and accepts no liability for cryptographic failures, user-side session key compromise, or malfunctions of distributed account abstraction protocols. When upgrading a subscription to a higher tier, the Platform provisions a new session key with a limit matching the baseline cost of the new level. Processing an upgrade and deploying the new session key are bundled within a single transaction, requiring a single signature from the user, and the previous session key ceases to be used by the Platform.

3.4. Automatic Payments and Network Gas Fees

The user acknowledges and agrees that the Base network charges gas fees for executing transactions. During automatic renewal, this network fee is calculated by the blockchain dynamically and withheld from the user's USDC balance over and above the subscription cost itself via the ERC-20 Paymaster model. The Platform does not control, set, or capture network fees. To protect the user's wallet from abnormal gas spikes on the Base network, the technical safety cap for a single automatic renewal transaction is set by the Platform at 0.50 USDC, monitored directly at the Platform's scheduler level. Actual gas charges in the vast majority of cases amount to less than 0.05 USDC, but during extreme network congestion, deductions may increase up to the specified safety cap. If the estimated network gas cost exceeds this limit, automatic renewal for that subscription will not be executed. If a subscription expires during a period of elevated network fees and renewal fails, the subscription changes to an expired status and no further automatic renewal attempts will be made.

3.5. Promo Codes and Promotional Campaigns

Promo codes and promotional discounts provided through the Platform have a limited duration and maximum usage limit set by the creator. Discounts from promo codes do not accumulate or stack with other promotions unless explicitly stated. Promo codes are personal and non-transferable.

3.6. Creator Revenue and Withdrawals

The Creator's earnings, net of the Platform's service fee (Section 3.1), are credited directly by the smart contract to the Creator's Smart Account (or wallet address) and remain under their exclusive non-custodial custody from the moment of settlement. The Platform does not accumulate, freeze, or hold custody over the Creator's funds and possesses no technical capacity to transfer, withdraw, or reverse them without the Creator's explicit cryptographic signature. Withdrawals, transfers, or any other movements of settled funds are initiated solely by the Creator independently via their wallet or the Platform's interface. Base network gas fees for these operations are paid by the Creator according to the models outlined in Section 3.2.

4. Code of Conduct and Comprehensive Content Policy

4.1. Absolute Safe For Work (SFW) Status

BOGEME.com is a public, mainstream, general-interest, and technology-oriented educational and creative platform. All public profiles, creator pages, landing elements, avatars, banners, visible text, and public pre-purchase previews must strictly maintain an absolute "Safe For Work" (SFW) status.

4.2. Prohibited Content Verticals

Users and creators are strictly prohibited from uploading, hosting, distributing, broadcasting, or adding external links to content that contains or promotes:

  • Pornographic or Sexually Explicit Material: Any materials of an explicit sexual nature, including but not limited to images/videos of real people engaged in sexual acts, masturbation, explicit or highly detailed artistic visualizations (including hentai, yaoi, yuri, anthropomorphic/furry pornography, and hypertrophied genital anatomy).
  • Violence and Harassment: Content promoting physical harm, self-harm, cruelty, harassment, hate speech, bullying, or the support of armed conflicts and unlawful militant groups.
  • Illegal Commodities and Dangerous Activities: Distribution, advertisement, or depiction of explosive materials, weapons, narcotic substances, or hazardous activities that could result in death or physical injury.
  • Gambling and Unlicensed Financial Operations: Promotion or hosting of online casinos, slot halls, card rooms, lotteries, unapproved betting, or providing unlicensed regulated financial advice and "get-rich-quick" schemes.
  • Copyright Infringement: Any unauthorized posting of pirated software, leaked materials, or content infringing upon third-party intellectual property or copyright frameworks.

4.3. Moderation Procedures and Interface Blocking

To protect the Platform's integrity, we utilize a dual layer of moderation:

  • Automated Systems: Continuous screening for anomalous transactional behavior and fraudulent patterns.
  • Manual Review: Specialized technical support audits conducted by humans, initiated by system flags, transaction spikes, or user complaints.

4.4. Anti-Abuse and Moderation Circumvention Prohibitions

Users are explicitly prohibited from: (a) creating multiple accounts after a profile has been blocked or removed; (b) exploiting smart contract vulnerabilities, manipulating transactions, or using automated tools to exploit the Platform; (c) attempting to circumvent the moderation system, including re-registration after a ban. Violation of these rules constitutes grounds for immediate and permanent termination of access to the Platform's interface without the possibility of recovery. The Platform utilizes automated systems to limit the frequency of network requests (Rate Limiting) and invisible behavioral analysis systems (CAPTCHA) at the server level. The use of any automated scripts, Puppeteer/Playwright parsers, or botnets to generate Dynamic.xyz authentication sessions is deemed a DoS attack on the infrastructure. The Platform reserves the absolute right to instantly and without warning block IP addresses, JA3 fingerprints, and data centers caught in abnormal request flooding.

4.5. Interface vs. Blockchain Data

Because blockchain data is cryptographically immutable and permanently stored on the open public network, BOGEME cannot delete, alter, or wipe data natively from the underlying blockchain. However, the Platform retains an absolute, final, and unrestricted right to immediately hide, block, freeze, or permanently remove a user's profile and front-end interface visibility on the BOGEME.com domain for any violation of this Code of Conduct.

5. No-Refund Policy and Intellectual Property Rights

5.1. Irreversibility of Smart Contracts

All subscription payments, single post unlocks, and tips executed via the Platform's smart contracts are final, absolute, and non-refundable. Blockchain transactions are by nature cryptographically irreversible. The Platform has no physical or technical capacity to execute banking chargebacks, fund reversals, or financial rollbacks in a Web2 style.

5.2. Platform Assets Protection

All code, custom graphics, user interface elements, brand styling, logos, text materials, and trademarks associated with BOGEME.com are the exclusive intellectual property of the Platform and its software developers. Any unauthorized copying, reverse engineering, scraping, or utilization of the Platform's code or interface is strictly prohibited.

5.3. User Content License

By publishing or distributing content on or through the Platform interface, you grant us a worldwide, non-exclusive, royalty-free, perpetual, transferable right to stream, cache, index, and display your media files solely to facilitate the technical rendering and functionality of the Platform.

6. Limitation of Liability and Warranty Disclaimer

THE BOGEME.COM PLATFORM, INTERFACE, AND SMART CONTRACTS ARE PROVIDED ABSOLUTELY ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

6.2. Technical and Blockchain Risks

THE PLATFORM EXPLICITLY DISCLAIMS ANY LIABILITY FOR BLOCKCHAIN REORGS, BASE NETWORK OUTAGES, CONGESTION, FORKS, RPC NODE LATENCY, THE STABILITY OF THIRD-PARTY APIS (INCLUDING DYNAMIC.XYZ), OR CRITICAL TECHNICAL MALFUNCTIONS OF DISTRIBUTED DECENTRALIZED PROTOCOLS.

6.3. Total Liability Cap

IN NO EVENT SHALL THE PLATFORM, ITS CORE DEVELOPERS, CONTRACTORS, OR PARTNERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR CRYPTOGRAPHIC ASSETS. THE TOTAL AGGREGATE LIABILITY OF THE PLATFORM FOR ANY VERIFIED LEGAL CLAIMS ARISING OUT OF THIS AGREEMENT IS STRICTLY CAPPED AT ONE HUNDRED USDC (100 USDC).

7. System Updates, Transition, and Litigation Termination

7.1. Right to Modify

The Platform reserves the right, at its sole discretion, to modify, amend, or rewrite any portion of these Terms to reflect technical upgrades, network changes, or compliance updates. Continued interaction with the site following updates implies your full acceptance of the revised Terms.

7.2. Limitation of Action

YOU AGREE THAT ANY LEGAL CLAIM OR CAUSE OF ACTION ARISING OUT OF OR RELATED TO YOUR USE OF THE PLATFORM MUST BE FILED WITHIN ONE (1) YEAR AFTER THE CAUSE OF ACTION ACCRUES, OR BE FOREVER BARRED AND VOID.

7.3. Language Precedence

These Terms are compiled, executed, and enforced strictly in their English language version. Any translations provided into other languages are done solely for your reading convenience and hold no binding legal authority over the English original.

7.4. Force Majeure

The Platform shall not be held liable for any failure or improper performance of its obligations if such failure is caused by circumstances beyond its reasonable control, including but not limited to: acts of God, wars, epidemics, large-scale communication or internet network failures, prolonged outages of critical third-party infrastructure (including the Base blockchain network, Paymaster services, Dynamic.xyz, and RPC node providers), government actions, or any other events outside the Platform's reasonable control. In the event of such circumstances, the Platform is obliged to make reasonable efforts to resume operations as soon as possible.
